I think all the folks who visit this thread must send out a complaint.
Also please contact your attorneys and tell them to complain on this half baked PIMS implementation.
My wife received her approval email from Mumbai consulate yesterday. When I contacted my attorney, he asked that after she returns to the US, to send him more details and he will lodge a complaint with the DOS through his liaison.

Thanks for the replies fellas, this isn't a renewal I am talking about. This is the first time I have applied for an EAD. BTW, does anyone know what's involved in converting from H4 to EAD status i.e.
1. Do you need to apply for SSN before you take a job offer?
2. EAD by itself is enough to accept employment?
3. Can you take jobs/resign as and when you please or do you have to somehow get back to H4 status if you quit job on EAD?
4. Does use of EAD by H4, change non-immigrant status of H1 worker?

I have quick question about I-485 filing date. What will be the filing date, the day I mail the packet or the day they receive or the day they acknowledge the receipt.
I am asking this because I cannot file my I-485 before August 15th due to some personal reasons. So suppose I prepare everything beforehand and mail it on August 16th - will that be appropriate filing (assuming the dates remain current in August)?

This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??
So life is not always easy. There are people waiting since 2002-03-04.

makes sense now.. EB3 I was 3576 in 2008 due to the spillover rule change. For 2006 and earlier Eb3 and EB2 were roughly the same?

Does anyone understand what is used to calculate the 3 year period for advanced degree olders?
Is the end of the three year period considered when you applied for LC, or when you apply for 485/140? Since, technically, people who are pending at the BEC as well as those who are affected by retrogression are still on NIV, and have not applied for immigrant Visa yet.
This point will have an impact on a lot of folks who may have applied for LC less than three years after getting their Degree but would have crossed that limit by the time they can apply for the immigrant Visa.

Before you file the law suit consider this,
The system is designed to get GC faster to the smarter (EB1, EB2, EB3 etc) or the rich (Investor). Sometimes circumstances decide in which queue you start the journey, Employer, attorney, how many days left in h1b etc, etc, etc
I do not like to jump queues and resent people who jump queues. But these are the people who look for opportunities and exploit them. These are the smart ones.
System favors people who are skilled (higher the better), By finding (new Labor, new I140) and using an opportunity these people have proved that they are worthy of the faster queue (eb3 to eb2, eb2 to eb1 etc).
What is wrong in rewarding the hardworking smart person with the original PD. After all that PD was established for that person(thank god LC sub is gone). That is the day an employer decided to sponsor GC for that person.

US Mortogage Economy is much bigger pie in which our share sometimes minimum (people like me who did not by home) and people who bought are venting out the prices are come down.
The fact of the matter is, anything is possible in US. Did not we hear Real Estate downs in New York and California in late 90s?
By saying that you want to make money by selling house, you are taking risk.
Now, if system provides a mechanism to walk away with a foreclosure, people will do it. It has been happening on Backruptcy and hence GOVT tightened it.
The foreclosure process might also get changed in future.
I do not know full details of ins and outs of Foreclosure so I will leave that to experts advice.
But please stop blaming each other!!!

While I agree in principle to what is being suggested here (I voted for this on Change.gov), I think it may be easier to win this battle with a smaller change:
The five year clock for obtaining US Citizenship (post Permanent Residency) must start at the time Adjustment of Status (I-485) has been filed.
For example: If you are approved for Permanent Residency after a long 5 year wait of filing your I-485, you should be eligible to apply for citizenship immediately without a further wait.
This takes away at least part of the suffering caused for the legal immigrant community. The effect of USCIS processing delays and visa retrogression can be mitigated at least when it comes to obtaining citizenship.

In order to utilize all visas under given category , NVC will start preparing application and forward to consulate. NVC is rarely wrong in their prediction, sometime they do start processing app in case USCIS fails act on enough cases in last quarter and in case if they have to forward date ahead they want to make sure consulates are ready with file to close.
Since this is June 2007 case , they might be expecting real GC allocation upto April 2007 but they want to keep buffer of 2 months.If person who posted this info is not making april fool joke then PD in last quarter will be defiantly up to June 2007.
Friends even I believe that looks like we will hit the Jul - Aug 2007 mark this year for EB2 things seem to be adding up well.
If we got 12K from EB1 and EB5 for the first 6 months then we should expect another 12K and even EB2 ROW usage is significantly down.

Not sure what is the total cost but given the years of wait and uncertainty $500 per person should be reasonable. I will also create a yahoo group to start these discussions.

10 yrs, 2 labors, 2 I-140's, 2-485's, more than 10 infopass appointments, two senator requests, more than 8 level 2 SR's, email to SCOPSSCATA and NCSCFollowup.Nsc@dhs.gov and then finally got CPO mail as christmas 2010 gift.
In my opinion the email helped move things lot FASTER. Took over 2.5 months after email to get the GC. I would like to thank all IV members for great insight and suggestions.

I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. Damn this sucking life man, no social life, no career life, no nothing life. Even animals must be living a better and meaningful life. It sucks big time, did it ever happen in history that uscis revised a visa bulletin on the day it is supposed to go into effect ....

Urging my acquaintances who are in the immigration Backlog to do the same..
Administrative fixes are a good idea.. I think the key to success in reforming the system will be a stealth and incremental reforms rather than any "CIR" type of fixes..

This disclaimer in VB, does not say "mid-month". It takes about cut off dates via bulletin only. Also, this means USCIS put some thought behind the time they will have to announce cut-off dates. They new the demand will ber "very heavy".
