On a more serious note, Can I port my red dots to green ones after i have been in reds for like a month? I won't be surprised if someone actually starts a thread with this kinda issue here.

Yes you can port it using AC21. IV will need to issue a new memo for it though. But your designation should be same. If you are a junior member, you need to post only as a junior member on IV forums.

If people can move freely between the categories then Why do we have categories?...:confused:
How are people moving "freely" between categories? Man, if this was so "free" then would we have anyone at all in EB3 and even EB2...everyone would have moved to EB1 !!
I do not think it is that "free". I personally do not think anyone would move jobs ONLY to move from EB3 to EB2. The move to EB2 could be a side-effect for a job move that was done for a whole different reason.
Everyone has the right to do what they feel is the right thing. I feel supporting IV is right and hence have participated in each campaign from the time I joined. Sunny and Rolling are doing what they feel is right.
I do believe in "As you sow, so you reap". Do good, get good in return (tried to translate 'kar bhala, ho bhala'). You all know whether what you are doing is right or wrong. When you reap the result of it, just remember that you got what you sowed. Be happy.

Well..congratulations indeed. After you interview, did you do open a SR, take InfoPass or talk to IO on phone about your case status?

Iam 2nd july concurrent filer.When i called uscis to check for name check status,the customer service lady replied,"Currently we r processing dec 2006 cases .we dont do the security check etc for ur case now until we deal with earlier cases..please check back later.".
Is this the answer u get when u call for name check status?Any july 2nd filer,can u post ur experience here???

Does one need to be physically present in US in order to file I-485 application? I had already booked my travel to India on May 25th before I came to know that the my Priority Dates had become current. Will I need to be in US till I get the filing receipt? I was curious on how would UCSIS know that I'm out of country on the day of filing?

I had my interview on Jan 14th for H1B extension..same company after 3 years..fortune 100 company..VO said approved..but i have not received my pp yet. Its the 18th day and in weeks this is the 3rd one.
My brother also works for the same company same mgr..he also went on the same day for his stamping. His F1-H1. his VO was different..he got his pp after one week.
Have there been people waiting more than three weeks ?? what is the worst wait time for someone here on the forum ??

Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.
Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.

I don't want to be a spoilsport.
But there is a possibility that EB2I has not yet retrogressed (inspite of heavy porting) because USCIS knows EB1C 12000 will flow to EB2 right. In that case we may not see movement of dates in par with 12000 spillover.
Maybe I am pessimistic.
In all calculations, it is mentioned that porting at max could be 6k/year. How did we come up with this number? Any proof or just a guess?

This is a very simple calculation. Following are the numbers before Oct -2006. These total to ~ 12K.
EB2-C - 3521
EB2-I - 9345
The dates will move further if more than 12K numbers are infused into the system. I would say that the dates should be in Oct - Nov 2006 range with these 12K numbers, having Nov as buffer as they may issue RFE's to folks.

This is because the "green card" (GC) is based upon a future job offer. The person is not required to have worked for the GC-sponsoring employer prior to filing or obtaining the GC.

Hey Bharatpremi, taking your numbers and assuming horizontal spill over instead of vertical would make eb2 all over current. total spill over from eb1 = 53807, total eb2 quota = 40040, pending eb2 = 74932
assume eb1 demand = 5000, eb2 demand = 20000
we can easily see eb2 getting completely approved.

Unfortunately the Timing of IV Advocacy day, and also May 2011 VB schedule at a wrong date. If the Govt Shutdown due to the budget deadlock, I'm not sure how both of these days will play out. Any Idea guys. :confused:
