    Looks like Obmudsman office have acknowledged the problem. Just read this on their site

These include, for example, where the beneficiary is ineligible for the benefits of the Form I-485 by statute, or the Form I-140 is withdrawn before the Form I-485 was pending for 180 days........

    I dont know what else I can do to have them look at my case, I have tried every possible avenue.

    Since you got a call from USCIS, I think its shouldnt be too long before your wife gets her GC.

    Here is a summary of the bills, their bill numbers and the Sections:

    Sen. Chuck Hagel's Bill (Section 202 of S. 1918)
    -High-tech workers who have worked in the U.S. for 3 years would be allowed to adjust to permanent resident status without regard to the annual employment-based immigrant visa cap of 140,000.
    -The spouses and children of immigrant workers would also be allowed to adjust status without regard to this cap.

    McCain/Kennedy Bill (Sections 601 and 602 of S. 1033)
    -Increases quota on EB immigrants to 290,000 to alleviate retrogression
    -Recapture unused visas between 2001 and 2005
    -Increase the per country limit from 7% to 10%

    Cornyn/Kyle Bill (Sections 1001 and 1002 of S. 1438)
    -Recapture of the unused visas between 2001 through 2005
    -Removal of diversity visa and reallocation of these. Since this is mentioned under EB, the implication seems to be reallocation to EB but am not sure.
    -Increase of the country limit from 7% to 10%

    It is understood that there would be a merging of these to make the final comprehensive immigration bill

    Senate Judiciary Committee Chairman Arlen Specter (R-Pa.) needed the assistance of the White House in early 2005 to overcome opposition within his own party to his chairmanship. In late November, Specter repaid the Bush Administration by unveiling draft legislation that would bring about a massive increase in government- mandated immigration to the U.S.

    President Bush, in his immigration address on November 28, pledged to work for an increase in the number of green cards issued each year and stated his intent to work with Sen. Specter to bring it about. Specter�s draft legislation would send government mandated immigration levels into the 2 million-a-year range.

    Under Specter�s draft legislation, the cap on family-preference immigration would be increased by 254,000 visas annually and hundreds of thousands of additional relatives would be exempted from annual limits. In addition, Specter proposes raising the cap on employment-based immigration by 150,000 a year, and allocating any unused visas to other preference categories.

    If enacted, Specter�s legislation would mandate the largest increase in immigration in this nation�s history. Moreover, according to FAIR�s analysis, such legislation would fuel the demand for still higher levels of immigration as more extended family members line up to follow an ever-growing number of immigrants streaming into our country.

    Seriously I am also sick of these violations and the companies everywhere in the world take law on a ride. No harm had happened to me but still irritates me when they get the GC in 1 year and we waiting for ever.

    Call USCIS and they should be able be give you the right direction. Please update us on how it goes.

    Letters sent. Is there any update from IV on getting this out to Media, Greg Siskind , Zoe Lofgren etc.? Or maybe we should wait till Feb 9th and see. Also, I am seeing many frustrated ppl on also since Feb bulletin. Encouraging them to come together with IV campaign.

    I have similar experience. I moved to sunrocket (which is now teleblend) from vonage. I pay half of what I used to pay vonage for same services/usage.

    currently teleblend offers $50 unlimited india calling + ofcourse US+canada unlimited. However as now vonage has come up with $25 world plan, I am sure teleblend would come up with something similar soon... may be $20 world plan or so. As they always price it below vonage. Let's hope! competition is good for consumer.

    I also had Teleblend world...but I removed the unlimited world as it was $35. Lets see they might come up with something like this.

    1.Policies must be flexible enough to respond to changing market conditions;

    6.Employment of unauthorized migrants must be curtailed.

    Thanks for your reply. Yes you are right but though I had the choice I was not allowed to enter on H1. Now when my AP is expiring on 01/26/2007 would it mean I may go out of status even if I have a valid h1 till 06/01/2007?

    Two of my colleagues on Nov 04 and Dec 04 didn't cleared out till.
    I don't think so they are on IV, but they will use 6 cards (1+1 in one case and 1+3 in another case)

    Since 2004 EB2 is cleared, I am seeing less number of posts being made on IV.Yay I became a senior member, will that mean I will get a green card?

    Yeah, I agree, but there is no other alternative.
    Both cases are genuine, not involving any labor substitution, so we can only hope that they are not rejected.

    We cannot file both together, becoz if one is entered in the system before the other, the second will get automatically rejected.

    My labor was filed in July 04 on EB2, but approved under EB3 category only. My attorney contacted uscis to with the amendment saying that my LC should have been approved under EB2 category. Finally, got a letter from uscis in Feb 2007 that my LC was approved under EB2. Could that be the reason that I did not get GC yet even my PD is current.

    This is not a bad idea.

    If everyone think this is a good idea, then we need to do this with a little more planning than the flower campaign.

    We can route the pizzas to hospitals and orphanages, shelter for the homeless etc also.

    Core group, please chew on this idea!

    I AM ORDERING PIZZA and gourmet food from local restuarants every week to be delivered to Emilio Gonzalez

    You want to foreclose for a matter of 20K -- I'm really surprised by your thinking process. Based on it, I would assume you had a zero down loan.

    In my opinion and this is my opinion only ( and this is only from a financial perspective only ), taking a hit on your credit report for 7 years for a 20k monetary hit doesnt make sense.

    the moral , ethical part of it -- well there are quite a few folks on either side of it and I'll let them continue arguing for/against it :-)

    I see that you guys didnt join IV until 2008. So, you know very less about this org. The people who only can think for their own wont come to join you at any stage, it was proven many times. They will just keep writing messages here and use valuable information on the forum.

    I am EB2/Masters/PD Nov 2004. I do not not support your idea. I loose patience at times, but not to the extent of effecting other peoples chances. I know quite a few of my freinds who had masters, their corporate employers applied in EB3, none of them are trying to do conversion. But, i feel their pain.

    Everyone that took part in the IV lobby day in September 2007 should get in touch with the lawmaker offices now and request them for letters. If you have met your local lawmaker offices through state chapters or on your own, it is time to visit them again for this request.

    I have printed 4 copies each (for my hubby & me) and will mail the letters tonight. Thank you again for this initiative and for providing the letter format. Makes the task easier.
